Please read these Terms of Service ("Terms") carefully before using the Study Ducks web application, website, and related services (collectively, the "Service") operated by Study Ducks ("us," "we," or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, content creators, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Accounts
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. Intellectual Property
The Service and its original content (excluding User Content, as defined below), features, and functionality are and will remain the exclusive property of Study Ducks and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Study Ducks.
3. User Content, AI-Generated Content, and Community Contributions
A. User Content and License Grant
The Service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material ("User Content"), such as custom prompts, study notes, or reviewed quizzes. You are solely responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, perform, display, distribute, and otherwise disclose the User Content for the purpose of operating, improving, and promoting the Service, including the training and refinement of our AI models.
B. AI-Generated Content and Quality Disclaimer
A core feature of the Service is the creation of study materials (e.g., quizzes, summaries) using Artificial Intelligence (AI) models.
- 1. AI Origin and Inaccuracies: You acknowledge and accept that content designated as "AI-Generated" is produced autonomously and may contain errors, inaccuracies, incomplete information, or content that is not fit for a specific purpose. This content is provided for educational assistance only and should not be considered definitive or a substitute for official academic materials or expert consultation.
- 2. Explicit Disclaimer of Accuracy: We expressly disclaim all liability for any loss, damage, or injury arising from the use of, or reliance on, any AI-Generated Content or any other information provided through the Service.
- 3. No Warranty of Completeness: The Service and its content may not cover all subjects, topics, or nuances. We do not warrant that any content, whether AI-Generated or human-reviewed, will be complete or fully comprehensive.
C. Human Review and Community Contribution
To promote quality and accuracy, the Service incorporates human oversight and community feedback mechanisms:
- 1. Human Review Requirement: We may require content designated as AI-Generated to undergo a human review by a qualified user or creator (including those in the future Creator Program) before it is labeled as "Verified" or "Reviewed." This human review is a secondary validation and does not transfer liability for inaccuracies to Study Ducks.
- 2. Community Suggestions: The Service allows all visitors and users to submit suggestions, corrections, or additions ("Suggestions") to any content (AI-Generated or User Content). By submitting a Suggestion, you grant Study Ducks a worldwide, royalty-free, perpetual, and irrevocable license to use, incorporate, and publish that Suggestion into the Service content without attribution or compensation to you.
- 3. Your Responsibility: You retain ultimate responsibility for verifying the accuracy of any content, regardless of whether it is AI-Generated, human-reviewed, or incorporates community Suggestions, before relying on it for academic or any other purposes.
4. Creator Program (Future Expansion)
Study Ducks may, at a future date, introduce a "Creator Program" or similar initiative that allows selected users to create, verify, and potentially monetize educational content ("Creator Content").
- 1. Program Terms: Participation in any such program will be subject to these Terms of Service and a separate, specific Creator Program Agreement or set of guidelines, which will outline responsibilities, content standards, monetization structure, and intellectual property rights concerning Creator Content.
- 2. Modification: We reserve the right to modify, suspend, or terminate the Creator Program at any time, for any reason, with or without notice.
5. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Reasons for termination include, but are not limited to, misuse of the Service, posting illegal or inappropriate User Content, or violation of any intellectual property rights.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
6. Limitation of Liability
In no event shall Study Ducks, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service, particularly inaccurate AI-generated content; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
7. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Study Ducks does not warrant that:
- 1. The Service will function uninterrupted, secure, or available at any particular time or location.
- 2. Any errors or defects will be corrected.
- 3. The Service is free of viruses or other harmful components.
- 4. The results of using the Service, particularly the AI-generated quiz content, will meet your requirements or be accurate, reliable, or complete.
8. Governing Law and Jurisdiction (Future Ready)
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree that any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts located in [Insert City in India, e.g., Bangalore].
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material (as determined solely by us), we will try to provide at least 30 days' notice prior to any new terms taking effect.
